Helping Clients Obtain Justice While Keeping Communities Safe
Robert Allard believes in using the law as a positive means of obtaining justice for his clients and creating a safer community for all. He has developed a reputation for taking tough cases where insurance companies offer little or no money to an injured victim and for providing aggressive representation which generates fair compensation.
In 2010, Allard was the driving force in uncovering the largest sexual abuse scandal in amateur athletics in the United States. His relentless legal work on behalf of a 14 year old girl molested by a USA Swimming coach has resulted in the national governing body that selects our Olympic swim team to make the protection of our young athletes a top priority. At the same time, the United States Olympic Committee announced that it was centralizing and standardizing background checks across all Olympic sports, thereby affecting approximately one million athletes.
Allard also secured a $3.375 million settlement in an amusement park accident that injured five children of a Calaveras County family. In the process Allard succeeded in getting the ride manufacturer to recall the amusement park ride. "Gaining justice against corporate wrongdoers is not always easy," said Allard. "In this case, the ride designer tried to cover up knowledge that would have prevented this tragic case in Calaveras County," added Allard.
For his outstanding legal work, Allard has twice been named the Santa Clara County Trial Lawyer of the Year (2007, 2009). The American Trial Lawyers Association has also named Allard as one of California’s Top 100 Trial Lawyers two years straight (2010, 2011).
In 2009 Allard won four cases, each starting with little or no monetary offers and ending with results well over one million dollars.
In a case that demonstrates the callous disregard that insurance companies can have towards an injured victim, Allard secured a $2.056 million arbitration award for a public school behavioral specialist who was seriously injured in a head-on car crash while traveling on a school field trip. Despite a clear case of liability, horrific injuries and hundreds of thousands of dollars in medical bills and lost wages, the school district's insurance relief fund never offered a penny in settlement and resorted to fighting the victim every step of the way. In another case, which involved a nursing assistant who suffered severe neck problems that required surgery after she was rear-ended at ten miles an hour, Allard took over the case from another law firm and secured $1.25 million from Allstate? For years Allstate claimed that a low speed accident could not cause such medical problems. Upon taking over the case Allard successfully developed the medical proof, including an admission from the defense doctor, that his client's pre-existing conditions triggered the neck injuries and subsequent surgical procedures.
Allard has also been honored as a 2009 and 2010 Northern California "Super Lawyer", an award given to only the top 5% of all attorneys. He has also received an "AV rating," the very highest accolade for legal ability and ethical standards under the peer review system of Martindale-Hubbell, the national legal directory.
A California Assembly Resolution authored in 2007 by State Assembly Speaker Pro Tempore Sally J. Lieber states that Allard "represents the finest qualities of a trial lawyer and the legal profession and has made a lasting impression on those individuals with whom he has been associated".
Consumer Attorneys of California (CAOC) honored Allard in 2007 with an Award of Meritorious Service, "For fighting against injustice by providing outstanding legal representation and service on behalf of your client".
Allard has been practicing law in Santa Clara County since January of 1994. He graduated from the University of Notre Dame in 1991, with a Bachelor of Arts degree. In 1994, Mr. Allard obtained his Juris Doctorate degree from the University of San Francisco. He has served as President for the Santa Clara County Trial Lawyers Association (2006) and, prior to that, served on its Board of Governors (2001-2005). He has lectured in the area of civil litigation for seminars entitled "Personal Injury Settlements in California" and "How to Litigate Your First Civil Trial in California." He also provides pro bono work for entities such as the Pro Bono Project in San Jose, California.
Allard, a third generation trial lawyer, tirelessly works for justice on behalf of his clients. His practice is focused exclusively on civil litigation, with an emphasis on personal injury, wrongful death and products liability. He is a devoted husband to his wife Niccole and father to Jacq, Shea, Caden and Ashton.
